Home-Based Business Veto Letters

The Florida League of Cities supports balancing entrepreneurship and the desire of residents to operate a home-based business with the potential impacts on residential neighborhoods and residential property values.

During the 2021 Legislative Session, the League engaged in good faith negotiations with legislators and interested stakeholders to reach a reasonable compromise on home-based businesses. But the bill that ultimately passed the Legislature drastically departs from this compromise. CS/HB 403 passed the Senate under questionable circumstances and is now on its way to the Governor’s desk for his possible signature.

As a result, the League sent a request to Governor DeSantis asking to him to veto CS/HB 403, which would create a significant preemption of Home Rule powers and the ability of local government to balance competing property rights. Additionally, the bill will void existing local ordinances or regulations that have tailored unique solutions to homeowner and business concerns.

The League encourages Florida’s 411 municipalities to support its efforts and craft a veto letter to the Governor. The League will collect all veto request letters submitted by municipalities and share them with the Governor, in addition to posting them on this page. If you have a letter you’d like the League to include to the Governor, please send it to Michaela Metcalfe at mmetcalfe@flcities.com
