Cameras at Red Lights (Support)

CS/CS/HB 325 (Reagan) clarifies local government authority to use cameras at intersections to enforce traffic laws. CS/CS/HB 325 preempts the use of cameras to the state and authorizes the Florida Department of Highway Safety and Motor Vehicles (DHSMV) to install traffic infraction detectors on state roads. Local governments can install cameras on state roads only if they receive a permit from the Florida Department of Transportation (FDOT). Cities are required to reach an interlocal agreement with a county to install cameras on county roads. Similarly, there must be an interlocal agreement for counties to install cameras on municipal roads.

CS/CS/HB 325 establishes a maximum fine of $158.00 and divides the money between the state General Revenue Fund and the governmental entity issuing the ticket. If the local government issues the citation it retains $75 and the remainder goes to the state. When the DHSMV issues the citation, the local government in which the infraction occurred receives $45.00. The bill requires the FDOT, by December 31, 2010 to develop specifications for the camera equipment and training standards for individuals reviewing the traffic infractions. Existing camera programs must comply with the FDOT specifications by July 1, 2011. The bill does not contain language that “ratifies” existing programs or past actions by local governments.
